I lost my iPod. But I still have my warinty on it. But

I can't jst go into the Apple Store and just say... "I lost it can I have another?" But my brother's iPod stopped working, so he just resently baught a ZOON. So couldn't I just use his broken iPod to exchange it for a new on ethat I DO need?
